SmartWeb Terms of Use

These terms of use set out how you may use the SmartWeb Online Account Service [www.smartweb.smartestenergy.com]. Please read these terms of use carefully before you start using SmartWeb. By using the service you confirm that you accept these terms of use and that you agree to comply with them.

We may revise these terms of use at any time by amending this page. Please check this page from time to time to take notice of any changes we may have made, as any changes are binding on you if you continue to use our portal.

Accessing SmartWeb

Access to our SmartWeb service is provided to any business that we have authorised for the purpose of managing their account with SmartestEnergy Business Ltd. It may be accessed and used by the business and its employees, or any other person that we have agreed, who requires access to and use of SmartWeb for the permitted purpose.

To access SmartWeb you must complete the registration for which we require a valid business name, account number and email address to be provided and maintained with us. The email address does not need to be the same as the email address stored for billing purposes. We may use the email address to administer access to SmartWeb and to communicate information relating to it and the services provided through it. Only one email address can be registered to use the SmartWeb service per account.

Authorised Users

Having completed the registration we are entitled to assume that any use of SmartWeb by your users have been authorised by you to do so. These terms of use are binding on all users of SmartWeb but you are responsible for, and remain liable to us, for your authorised users' compliance with these terms of use. You will take reasonable steps to ensure that your authorised users comply with these terms of use.

Passwords

The password you choose to access SmartWeb must be treated as confidential and must not be disclosed to any other person. We have the right to disable any user password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.

If you know or suspect that a user password has become known to anyone other than the user to whom it relates, you must promptly notify us by contacting our Customer Services on 01903 703400 or smartweb-sme@smartestenergy.com . Alternatively reset the user password by using the ‘Forgotten Password’ link on the SmartWeb home page. You will be liable to us and indemnify us for any costs, losses or damages resulting from any unauthorised use of a user password that relates to you.

Our Software

SmartestEnergy Business Ltd is the owner of the intellectual property rights of the SmartWeb Online Account Service. We grant to you a non-exclusive, non-transferable licence to access SmartWeb and to use its software solely for the permitted purpose in accordance with these terms of use.

You must not: (a) attempt to copy, duplicate, modify, disclose or distribute any part of the SmartWeb service; (b) attempt to disassemble, de-compile, reverse engineer or create derivative works based on the whole or any part of our software; (c) attempt to obtain, or assist others in obtaining, access to our software, other than for the permitted purpose; or (d) use our software to provide services to any other person, other than for the permitted purpose.

You have no rights in, or to, our software or our portal other than the right to use it in accordance with these terms of use. You acknowledge that you have no right to have access to our software in source code or in unblocked coding or with comments.

Service Data

We grant to you and your authorised users a non-exclusive, non-transferable licence to view, copy, download, print and use our service data for the permitted purpose, and to make the service data available to you and any other person to whom the service data relates. You must not alter any part of the service data. You and your authorised users have no rights in, or to, our service data other than the right to use it in accordance with these terms of use.

Suspension and Termination

We reserve the right to determine, in our absolute discretion, whether you or your authorised users have breached these terms of use. If a breach of these terms of use has occurred, we may take such action as we deem appropriate, which may include (without limitation) the immediate, temporary or permanent removal of your right to use SmartWeb, software and service data. We will have no liability to you or your authorised users for actions taken by us in response to a breach of these terms.
